Neither of them are a big deal and don't hamper the operation. I tested it and it works as I should. The battery will not hold a charge. Comes with a stack of blank DVDs. There is one DVD in the camera that has some video on it of a train trip on the Oregon coast. I didn't watch the whole thing so no telling what else may show up. Nice case for it too.
